ClickAndCall User Policy, Privacy, Billing & Disclaimer

Important Notice

ClickAndCall is not for emergency or time-sensitive use. Calls may fail, be delayed, drop, or have poor audio quality. Do not rely on ClickAndCall for urgent, critical, or life-safety communications.

Eligibility

You must be at least 18 years of age to create an account or use ClickAndCall. By creating an account, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms & Conditions. If you are under 18, you may not use this service.


Service Description

What ClickAndCall Provides

ClickAndCall is a browser-based communication platform that:

  • Enables website visitors to initiate voice calls directly from a browser
  • Connects users to a business phone line without downloads or installations
  • Provides embeddable call buttons and routing tools
  • Facilitates real-time communication between website visitors and businesses

Service Limitations

ClickAndCall is not:

  • A traditional telephone company or emergency service provider
  • A guaranteed call delivery or uptime service
  • A replacement for dedicated phone systems
  • Responsible for call quality affected by internet, browser, device, carrier, or network limitations

Emergency & Time-Sensitive Use Disclaimer

ClickAndCall is strictly not intended for emergency communications or time-sensitive transactions.

  • The service must never be used to contact emergency services, including 911
  • The service must not be relied upon for urgent, critical, or life-safety communications
  • Call connection, routing, and delivery are not guaranteed and may be delayed, interrupted, or fail without notice

By using ClickAndCall, you acknowledge and agree that:

  • You will not rely on the service for emergencies or urgent matters
  • ClickAndCall is not responsible for damages, losses, or harm resulting from delayed, failed, or missed communications
  • You assume all risk for any use of the service in time-sensitive situations

Voice Quality Disclaimer

ClickAndCall cannot guarantee voice quality, connection clarity, or call performance. Call quality may be affected by factors outside ClickAndCall's control, including:

  • The website visitor's internet connection
  • The website visitor's device, browser, microphone, or speaker
  • Wi-Fi strength, mobile hotspot quality, or network congestion
  • The business phone line, carrier, or receiving device
  • Third-party network routing or service interruptions

User Responsibilities

Account & Usage

You are responsible for:

  • Maintaining the security of your account
  • Properly configuring call routing and availability
  • Ensuring your contact number is accurate and operational

Proper Use of ClickAndCall

ClickAndCall is an inbound-only communication tool. The service allows website visitors to click a call button and connect only to the business phone number configured for that website. ClickAndCall does not provide an open dial pad for placing calls to outside phone numbers. Any keypad functionality is limited to entering an extension or navigating the connected business phone system.

You agree not to use ClickAndCall to:

  • Route calls to unauthorized, misleading, or incorrect phone numbers
  • Use the service in connection with fraudulent, deceptive, illegal, or abusive business practices
  • Encourage or facilitate harassment, threats, scams, or unlawful communications
  • Violate privacy, consumer protection, or call recording laws
  • Attempt to modify, bypass, reverse engineer, overload, or misuse the platform
  • Use the service for emergency, urgent, critical, or life-safety communications

Legal Compliance

You are solely responsible for complying with all applicable laws, including privacy and data protection laws, and call recording and consent laws.

Account Information

  • Name, email address, and login credentials
  • Business name and contact details
  • Account and subscription status

Call Data

  • Call date and time
  • Call duration
  • Call routing information
  • Device and browser information

ClickAndCall does not record calls and does not guarantee storage of call data.

Technical Data

  • IP address
  • Browser type and version
  • Device type
  • Usage logs and system activity

How We Use Information

We use data to:

  • Provide and operate the service
  • Route calls to your business
  • Monitor performance and reliability
  • Improve functionality
  • Detect and prevent abuse

Payment Processing

ClickAndCall does not store or process payment card information. All payments are securely handled by Stripe. Your payment details are governed by Stripe's policies.

Data Sharing

We may share data with:

  • Third-party infrastructure providers required to operate the service
  • Payment processors
  • Legal authorities when required by law

We do not sell personal data.


Call Usage & Billing

Billing

  • Services are billed monthly unless otherwise stated
  • Plans may include bundled call minutes
  • Additional usage may be billed
  • All fees are charged in advance, non-transferable, and subject to applicable taxes and fees

Payments

  • Payments are processed by Stripe
  • ClickAndCall does not store payment information
  • A valid payment method is required
  • Failure to pay may result in suspension or termination

Refund Policy

All payments are non-refundable except as outlined below. If ClickAndCall is unable to provide the service, experiences outages, or fails to perform as expected, your sole and exclusive remedy is a refund of the amount paid for the affected monthly billing period.

No refunds will be provided for:

  • Partial use of services
  • Failure to use the service
  • User configuration issues
  • Internet, device, browser, microphone, speaker, or network problems
  • Business phone, carrier, or receiving device issues
  • Third-party network or infrastructure problems

Cancellations

  • You may cancel at any time
  • Cancellation takes effect at the end of the billing cycle
  • No prorated refunds will be issued

Prohibited Uses

You may not use ClickAndCall to:

  • Misrepresent the business, destination, or purpose of a call
  • Route calls to numbers not owned, authorized, or controlled by the account holder
  • Abuse, overload, interfere with, or attempt to compromise the platform
  • Use the service in connection with fraud, scams, or illegal activity
  • Use the service for emergency or life-critical communication

Enforcement

Violations may result in suspension or termination, loss of service without refund, and legal action if required.


Account Termination

Termination by ClickAndCall

ClickAndCall reserves the right to suspend or terminate your account at any time, for any reason or no reason, with or without notice, and without liability to you. Reasons for termination may include, but are not limited to, violations of these Terms, non-payment, fraudulent or abusive behavior, or any other conduct ClickAndCall determines, in its sole discretion, to be harmful to the service, other users, or the business.

Upon termination, your access to the service will be immediately revoked. No refunds will be issued for any unused portion of a billing period unless required by applicable law.

Termination by You

You may cancel your account at any time through the customer portal. Cancellation takes effect at the end of the current billing cycle. No prorated refunds will be issued.


Liability & Disclaimers

ClickAndCall is provided "as is" without warranties. We do not guarantee successful call connection, consistent call quality or availability, compatibility with all systems, browsers, devices, or networks, or that the service will meet every business need or expectation.

Limitation of Liability

If ClickAndCall is unable to provide the service, your sole remedy is a refund of the amount paid for that monthly billing period. ClickAndCall is not liable for lost revenue, lost leads, missed calls, poor call quality, dropped calls, delayed calls, business interruptions, indirect or consequential damages. Total liability will not exceed the amount paid for the affected month.

Indemnification

You agree to indemnify ClickAndCall from claims arising from your use, legal violations, or harm caused to third parties.


General Terms

Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law principles. You agree that any legal action arising out of or relating to these Terms shall be subject to the dispute resolution process outlined below.

Dispute Resolution & Arbitration

We hope to resolve any issues directly. If you have a concern, please contact us first and we will make a good-faith effort to resolve it informally within 30 days.

If a dispute cannot be resolved informally, both parties agree to resolve it through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration will be conducted in Wake County, North Carolina, or by telephone or video conference at either party's request.

For claims under $10,000, ClickAndCall will pay all AAA filing, administration, and arbitrator fees unless the arbitrator finds the claim to be frivolous. For claims over $10,000, fee allocation will follow the AAA Consumer Arbitration Rules.

Class action waiver: You agree that disputes will be resolved on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Either party may seek emergency injunctive relief in a court of competent jurisdiction in Wake County, North Carolina to prevent irreparable harm while arbitration proceeds.

Changes to Terms

We may update these Terms & Conditions at any time. When changes are made, we will notify active account holders via a notice in the Customer Portal. Your continued use of the service after the effective date of any update constitutes your acceptance of the revised terms. We encourage you to review the Terms periodically.
